Terms and Conditions

Tutoring Terms and Conditions:
 

Booking Confirmation

  • All tutoring sessions are confirmed upon receipt of payment.

  • Bookings are subject to availability and allocated on a first-come, first-served basis.

Payment

  • Full payment must be made monthly and received at least 48 hours before the first scheduled session of the month.

  • If payment is not received on time, sessions may be cancelled and the student's time slot may be offered to another student.

  • Repeated missed or late payments may result in permanent withdrawal from the tutoring programme.

 

Cancellation and Refund Policy

1:1 Lessons

  • One cancellation per half term is allowed free of charge if at least 48 hours’ notice is given.

  • Same-day cancellations due to illness may be accepted once every six months.

  • Any additional cancellations will be charged in full. Lesson materials will be provided, and we may offer a rearranged session where possible.

Group Lessons

  • No refunds, credits, or transfers are available for missed group lessons at any point during the month, regardless of reason.

  • When a student secures a group place, that spot is reserved and cannot be taken by another student.

  • Missed group sessions are not rearranged. Materials from the lesson will be shared via Google Classroom for independent review.

  • Parents may choose to book a 1:1 catch-up session at the standard rate if preferred.

Masterclasses

  • All bookings for masterclass events are non-refundable and non-transferable.

 

No-Show Policy

  • If a student does not attend a session without prior notice, the session will still be charged in full and will not be rescheduled.

Rescheduling

  • One reschedule request is permitted per half term.

  • Additional requests may incur extra charges and are subject to tutor availability.

Late Arrival

  • Tutors will make every effort to use the remaining time, but no additional time will be added if a student arrives late.

Student Responsibility and Effort

  • Students must bring any required materials and provide accurate information about their academic needs.

  • Students are expected to give 100% effort, participate actively in sessions, and complete independent study between lessons.

  • This includes practising programming (if applicable), completing tasks, and reviewing course content.

  • Smash Your Exams is not responsible for underperformance if students fail to engage fully.

Tutoring Environment

  • Lessons must take place in a quiet, distraction-free environment.

  • Disruptive behaviour (e.g. misuse of chat, inappropriate language) may result in the session being ended without refund.

  • In group or masterclass sessions, students who disrupt the session may be removed without a refund.

Parent/Guardian Interference

  • Parents or guardians should not intervene in tutoring sessions unless specifically invited by the tutor.

  • Repeated interference may lead to the termination of services without refund.

Code of Conduct

  • All students and parents are expected to behave respectfully.

  • Inappropriate behaviour may result in immediate and permanent removal from the tutoring programme, with no refund.

Intellectual Property

  • All lesson slides, worksheets, and resources remain the intellectual property of Smash Your Exams.

  • Materials may not be copied, shared, or redistributed without written permission.

Technical Issues

  • Smash Your Exams is not responsible for technical difficulties on the client’s side, such as poor internet or device failure.

  • Missed sessions due to these issues are not refundable.

Force Majeure

  • In the event of illness, natural disasters, platform outages, or other circumstances beyond our control, sessions may be cancelled or rescheduled.

  • Refunds in these situations will be assessed on a case-by-case basis.

Feedback and Complaints

  • We welcome feedback and are happy to address any concerns. Please contact us promptly so we can work to resolve any issues.

Changes to Terms

  • By booking our tutoring services, you confirm that you agree to these terms and conditions.

  • Smash Your Exams reserves the right to update these terms at any time. Parents will be notified of any changes via email.

Educational Consultancy Terms and Conditions:

Disclaimer of Liability for Exam Board Results:

  • Assumption of Risk:
    1.1 The educational consultancy services, coursework consulting, and coursework marking provided by Smash Your Exams are based on our experience of the course, the exam board, and the requirements of the specification.

    1.2 The customer acknowledges and agrees that the assessment of coursework and any educational advice provided is undertaken at their own risk.

  1. No Guarantee of Exam Board Results:
    2.1 Smash Your Exams does not guarantee the accuracy or acceptance of coursework marks by the exam board.

    2.2 The customer understands that exam board decisions are independent of Smash Your Exams, and Smash Your Exams cannot be held accountable for any discrepancies or inaccuracies in the marks assigned by the exam board.

  2. Reliance on Consultancy Services:
    3.1 The customer acknowledges that the educational consultancy services, including coursework consulting and marking, are based on professional judgment and expertise.

    3.2 Smash Your Exams shall not be liable for any loss, damage, or inconvenience suffered by the customer arising out of or in connection with reliance on the consultancy services.

  3. Limitation of Liability:
    4.1 To the fullest extent permitted by law, Smash Your Exams shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with the educational consultancy services.

    4.2 The total liability of Smash Your Exams, whether in contract, tort, or otherwise, shall be limited to the fees paid by the customer for the specific consultancy service in question.

  4. Indemnification:
    5.1 The customer agrees to indemnify and hold Smash Your Exams harmless from any claims, liabilities, damages, costs, and expenses arising out of or in connection with the educational consultancy services.

 

By booking our consultancy services, you acknowledge that you have read, understood, and agree to abide by these terms and conditions. We reserve the right to update or modify these terms at any time, and clients will be notified of any changes.
